GROUPIES LOYALTY PROGRAM
TERMS AND CONDITIONS
The Groupies loyalty program is offered by Geronimo Hospitality Group, LLC, or its subsidiaries, licensees, and affiliated companies (collectively, “Geronimo”). The Groupies loyalty program is one way in which Geronimo rewards and thanks loyal customers for their business. Members are able to earn and accumulate “Points” that can be redeemed for discounts at participating Geronimo location as further explained in these Terms and Conditions.
PLEASE READ THESE TERMS AND CONDITIONS CAREFULLY. BY ACCESSING, USING, OR OTHERWISE PARTICIPATING IN THE GROUPIES LOYALTY PROGRAM, YOU AGREE TO BE BOUND BY THESE TERMS AND CONDITIONS, AS THEY MAY BE CHANGED FROM TIME TO TIME, AND ALL TERMS INCORPORATED BY REFERENCE. YOU SHOULD REVIEW THESE TERMS AND CONDITIONS AND RELATED POLICIES FREQUENTLY TO UNDERSTAND THE TERMS AND CONDITIONS APPLICABLE TO YOUR PARTICIPATION IN THE GROUPIES PROGRAM. IF YOU DO NOT AGREE TO ALL OF THESE TERMS, DO NOT PARTICIPATE IN THIS PROGRAM.

The Groupies program is offered through the GeroniApp mobile app, which is provided by Incentivio, Inc. In order to join Groupies, you will need to sign up for an account using the GeroniApp mobile app or online at https://order.incentivio.com/c/GeronimoHospitalityGroup/. In doing so, you agree to Incentivio’s Terms of Use (available at https://order.incentivio.com/termsofuse.html) and Privacy Policy (available at https://www.incentivio.com/privacy/). If there is a conflict between these Terms and Conditions and the Incentivio’s Terms of Use relating to the administration of the Groupies program, these Terms and Conditions will control. Incentivio’s Terms of Use will control in all other respects, including, without limitation, how users use and interact with the GeroniApp mobile app.
Joining Geronimo Loyalty Rewards.
All U.S. residents age thirteen (13) or older are eligible to join the Groupies program. You may only have one (1) Groupies account, which is personal to you. Groupies is not targeted towards, nor intended for use by, anyone under the age of thirteen (13). If you are between the ages of thirteen (13) and eighteen (18), you may only participate in Groupies under the supervision of a parent or legal guardian who agrees to be bound by these Terms and Conditions. There are no membership fees associated with Groupies. Any employee and immediate family members of employee (i.e., parents, siblings, spouses and children) of Geronimo are eligible to join Groupies.
In order to join Groupies, you will need to sign up for an account in the GeroniApp mobile app or online at https://order.incentivio.com/c/GeronimoHospitalityGroup/. There is no cost for creating a Groupies account, though data and messaging rates may apply when using the app. The registration process may require that you provide the following information: name, mobile phone number, email address, and birthday. After registering, your mobile phone number will be your GeroniApp account number (“Account Number”).
Earning Points.
Subject to the limitations and restrictions set forth in these Terms and Conditions, Groupies members earn Points by completing transactions at participating Geronimo locations (each a “Qualifying Purchase”), which include, without limitation, all food and beverage purchases and hotel reservations. All locations operated by Geronimo participate in the Groupies program.
You will not earn Points on any portion of Qualifying Purchases paid with a discount earned through Groupies, coupon, or other discount or promotion (including Geronimo employee discounts). However, you will earn Points on the amount of the Qualifying Purchase for which you actually pay.
Subject to the restrictions below, you will receive one (1) Point for each dollar spent on a Qualifying Purchase at participating Geronimo locations, excluding tax, gratuity, and service charges. You will accumulate Points commencing with the first Qualifying Purchase and will continue to accumulate Points with each additional Qualifying Purchase.
The following restrictions apply to the accumulation of Points:
You must present your Account Number at the time of purchase to receive Points. Failure to present your Account Number will result in forfeiture of any Points that may have otherwise been earned.
New members will not be issued Points retroactively for purchases made prior to enrolling in Groupies.
Members may earn Points only for the portion of a Qualifying Purchase which the member pays (for example, if a dining check is split among guests, the member will receive Points only for the portion of the check that the member pays).
If you do not pay the full amount due at the time of your Qualifying Purchase, Geronimo reserves the right to (a) withhold Points until you have paid all amounts due in full, (b) adjust the amount of Points awarded to you based on the final amount you actually pay, and (c) revoke Points if the unpaid balance is not paid by the due date set forth on the invoice or other agreement between you and Geronimo.
Once earned, your Points do not expire.
Groupie Discounts; Benefits.
As your Points accumulate, you may redeem them for discounts in the GeroniApp to be used on Qualifying Purchases (“Discounts”). You will receive a $0.03 Discount for each point redeemed. For example, if you redeem 20 Points, you will receive a $0.60 Discount; if you redeem 100 Points, you will receive a $3.00 Discount. Points are redeemable for Discounts solely in the GeroniApp mobile app and may be changed at any time and from time to time without notice. Discounts may be used only at participating locations and may be applied towards all Qualifying Purchases, except for (a) membership fees, such as at Be Fitness and The Beloit Club, (b) private lessons or instruction, such as personal training at Be Fitness or golf lessons at The Beloit Club, and (c) discounted or free alcohol where prohibited by law. Discounts may not be applied to the purchase of any other good or service not set forth in these Terms and Conditions.
Discounts, including use and redemption thereof, are subject to any terms set forth in the GeroniApp and these Terms and Conditions. You must present your Account Number when completing your transaction in order to use your Discounts. Discounts may not be re-sold or exchanged for other goods or services. Discounts are not valid with any other offers, discounts, or promotions. Neither Geronimo nor Incentivio is responsible for (a) replacing lost or stolen Points or Discounts, or (b) delayed or lost communications sent over the Internet or over any other form or method of delivery.
You may receive other benefits by participating in Groupies, such as notifications of upcoming events and member-only promotions and offers. All Groupies benefits are subject to change at any time without notice.
Disclaimers; Limitations on Liability.
PARTICIPATION IN GROUPIES AND RECEIPT OF ANY OF ITS ASSOCIATED BENEFITS IS AT YOUR SOLE RISK. ANY GROUPIES DISCOUNTS EARNED AND ANY OTHER BENEFITS THAT MAY BE PROVIDED TO YOU BY GERONIMO ARE PROVIDED ONLY ON AN "AS IS" AND "AS AVAILABLE" BASIS. GERONIMO EXPRESSLY DISCLAIMS ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT. EXCEPT AS OTHERWISE PROVIDED BY LAW, NEITHER GERONIMO NOR INCENTIVIO WILL BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR EXEMPLARY DAMAGES, INCLUDING, BUT NOT LIMITED TO, DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA, OR OTHER INTANGIBLE LOSSES (EVEN IF GERONIMO HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES) RESULTING FROM (i) THE USE OR INABILITY TO USE THE GERONIAPP MOBILE APP; (ii) THE USE OR THE INABILITY TO USE GROUPIES OR ANY BENEFITS THEREOF; (iii) THE COST OF PROCUREMENT OF SUBSTITUTE GOODS AND SERVICES RESULTING FROM ANY GOODS, DATA, INFORMATION, OR SERVICES PURCHASED OR OBTAINED OR MESSAGES RECEIVED OR TRANSACTIONS ENTERED VIA THE USE OF GROUPIES; (iv) UNAUTHORIZED ACCESS TO OR ALTERATION OF MEMBER’S PROGRAM DATA; OR (v) ANY OTHER MATTER RELATING TO THE GROUPIES PROGRAM.
Indemnification.
You agree to release, indemnify and hold harmless Geronimo from all liabilities, claims and expenses, including, without limitation, attorneys’ fees, arising out of or in any way related to your breach of these Terms and Conditions. Further, you agree to reimburse Geronimo for any Groupies benefits that were fraudulently obtained by you.
Amendment to Terms and Conditions.
Geronimo may amend, modify, or otherwise change these Terms and Conditions at any time without notice or liability, even if the changes affect Point quantities and/or discount amounts, values and earning or redemption opportunities, by posting revised Terms and Conditions located at https://www.geronimohospitalitygroup.com/geroniapp. Geronimo may change the list of participating locations at any time and from time to time without notice. Any such amendment or change will take effect immediately upon posting, unless otherwise provided, and you waive any right you may have to receive specific notice of such amendments, modifications, or changes. You may view the current version of these Terms and Conditions at any time at the above link. You are responsible for checking for updates to Groupies program terms from time to time.
Cancellation of Groupies.
Geronimo may cancel the Groupies program at any time. You will be notified of any such cancellation in the manner provided by applicable law prior to the effective date of the change. You may cancel your GeroniApp account by contacting us. If you cancel voluntarily, you will forfeit any previously accumulated Points.
Geronimo or Incentivio may terminate your account and/or your participation in Groupies or your use of the GeroniApp if Geronimo or Incentivio determines in their sole discretion that you have violated these Terms and Conditions, the Incentivio Terms of Use, you have more than one (1) account, or that the use of your account is unauthorized, deceptive, fraudulent, or otherwise unlawful.
Governing Law.
These Terms and Conditions, and the respective rights and obligations of the parties are governed by and will be construed in accordance with the laws of the State of Wisconsin.
Binding Arbitration.
Any claim or controversy arising out of or relating to these Terms and Conditions will be settled by arbitration held in Beloit, Wisconsin, and administered by the American Arbitration Association under its Commercial Arbitration Rules (including, without limitation, the Supplementary Procedures for Consumer‐Related Disputes), and judgment on the award rendered by the arbitrator(s) may be entered in any court having jurisdiction thereof. Any such claim or controversy will be arbitrated on an individual basis and may not be consolidated with any claim or controversy of any other party. The foregoing shall not preclude Geronimo from seeking any injunctive relief in state or federal courts for protection of its intellectual property rights (including the rights of its licensors).
Miscellaneous.
These Terms and Conditions do not alter in any way the terms or conditions of any other agreement you may have with Geronimo for products, services, or otherwise.
Corporations, groups, organizations, associations, and all other non-natural persons cannot enroll in the Groupies program. Members must comply with their own company or organization’s policies regarding loyalty programs. Members are solely responsible for notifying their employer, principal, and/or client of any benefits or points received.
Points and Discounts earned through the Groupies program are promotional and have no cash value.
